THE HOP SHOP LLC

Terms & conditions
of service.

Effective October 30, 202633 sections

These Terms & Conditions of Service (“Terms”) apply to automotive repair, diagnostic, maintenance, detailing, roadside, mobile, inspection, and related services performed by The Hop Shop LLC, doing business as The Hop Shop – Mobile Auto Care (“The Hop Shop,” “we,” “us,” or “our”).

By booking an appointment, approving an estimate or work order, paying a deposit, electronically accepting service, signing an authorization, or otherwise authorizing The Hop Shop to perform work, the customer agrees to these Terms.

CUSTOMER AUTHORIZATION

#

The customer represents that they are the vehicle owner or have authority from the owner to authorize work on the vehicle.

The customer authorizes The Hop Shop to perform only the services, diagnostic procedures, repairs, parts replacement, or other work that the customer has approved.

Additional work that materially changes the approved scope or price will require further customer authorization before being performed, except where immediate action is reasonably necessary to protect persons or property and permitted by law.

Authorization may be provided electronically, in writing, by text message, through The Hop Shop's booking or invoicing systems, or by another method reasonably documenting the customer's approval.

ESTIMATES AND PRICING

#

Estimates are based on the information reasonably available at the time they are prepared.

Automotive repair frequently involves concealed damage, seized or corroded components, previous repairs, modified components, incorrect prior installations, broken fasteners, unavailable parts, or additional failures that cannot reasonably be identified before disassembly or diagnostic testing.

An estimate is not a guarantee that additional problems will not be discovered.

The Hop Shop will obtain customer approval before performing additional work that materially exceeds the authorized scope or approved price.

Pricing may include labor, parts, materials, supplies, disposal charges, taxes, subcontracted services, mobile-service charges when applicable, and other charges disclosed on the estimate or work order.

DIAGNOSTIC SERVICES

#

Diagnostic services compensate The Hop Shop for technician time, testing, research, equipment use, inspection, data analysis, disassembly when authorized, and professional evaluation.

Payment for diagnostic services is due whether or not:

  • the vehicle ultimately receives repairs;
  • the customer approves the recommended repair;
  • the customer's concern can be duplicated during the appointment;
  • testing produces a definitive single-component diagnosis;
  • additional testing is required; or
  • the vehicle has multiple overlapping faults.

Automotive diagnostics often involve a process of elimination. An initial diagnosis may identify the most likely or currently verifiable failure without eliminating the possibility of additional underlying problems.

Unless otherwise stated on the estimate, when the customer approves a qualifying repair recommended as a result of a paid diagnostic service, The Hop Shop's diagnostic fee will be applied as a credit toward that approved repair.

A diagnostic finding is not a guarantee that the identified repair will correct every existing or future vehicle concern.

REPAIRS DO NOT GUARANTEE A PERFECT VEHICLE

#

Vehicles may have multiple independent, intermittent, hidden, pre-existing, progressive, or unrelated failures.

Repairing one diagnosed or authorized problem does not mean that every condition affecting the vehicle has been identified or corrected.

Completion of an authorized repair does not represent or guarantee that:

  • the vehicle has no other defects;
  • all warning lights will remain off;
  • all noises, vibrations, leaks, drivability concerns, or electrical concerns will be eliminated;
  • another component will not subsequently fail; or
  • the vehicle will be restored to new or perfect condition.

If the original symptom remains after an authorized repair, additional diagnosis may be required.

The existence of another problem, an unresolved secondary problem, or a subsequent component failure does not by itself establish that the original repair was improperly performed.

MOBILE SERVICE CONDITIONS

#

The Hop Shop performs many services at customer-selected locations rather than in a traditional repair facility.

The customer is responsible for providing a legal, reasonably level, safe, accessible work area with adequate clearance around the vehicle.

The Hop Shop may refuse, pause, reschedule, or discontinue work when conditions are unsafe or impractical, including conditions involving:

  • traffic or roadway hazards;
  • severe weather;
  • inadequate vehicle clearance;
  • unstable ground;
  • unsafe parking locations;
  • aggressive animals;
  • hazardous materials;
  • inadequate lighting;
  • unreasonable interference by occupants or third parties; or
  • conditions preventing proper lifting, testing, repair, or operation of equipment.

Some procedures may require a traditional shop environment, vehicle lift, alignment rack, specialized machine, extended disassembly, machining, fabrication, towing, or another service provider.

The Hop Shop does not guarantee that every diagnosed repair can be completed mobile.

APPOINTMENTS, ACCESS, AND DELAYS

#

Appointment times are estimates and may be affected by prior jobs, traffic, parts availability, weather, diagnostic complexity, emergency circumstances, or other conditions beyond The Hop Shop's reasonable control.

The customer must ensure that:

  • the vehicle is accessible at the agreed location;
  • keys or access methods are available;
  • security systems or locked areas do not prevent service;
  • the vehicle contains sufficient fuel or battery charge when reasonably needed for testing; and
  • the technician has permission to operate the vehicle where necessary.

The Hop Shop is not responsible for delays caused by unavailable parts, shipping delays, incorrect parts supplied by third parties, weather, customer access issues, or other circumstances reasonably outside its control.

BOOKING DEPOSITS

#

A $150 booking deposit is required for each appointment unless a manager expressly approves different terms.

If the total scheduled service price is less than $150, the full scheduled service amount may be required as the deposit.

Larger repairs or projects may require an additional or higher parts deposit before parts are ordered.

Deposits are applied toward the customer's final balance.

A deposit may become non-refundable to the extent reasonably associated with:

  • special-order or non-returnable parts;
  • parts already purchased for the customer's vehicle;
  • technician time or preparation already incurred;
  • late cancellation;
  • failure to provide access to the vehicle; or
  • a missed appointment.

Any cancellation or deposit policy remains subject to applicable law.

PARTS

#

The Hop Shop may use original equipment, original-equipment-equivalent, aftermarket, remanufactured, rebuilt, recycled, or other appropriate parts as disclosed or reasonably appropriate for the authorized repair.

Availability and pricing can change before parts are ordered.

Special-order, electrical, programmed, VIN-specific, opened, installed, used, or otherwise non-returnable parts may not be eligible for cancellation or refund once ordered.

Removed parts will be handled in accordance with applicable law and any customer request made before or at the time of service.

Parts replaced under manufacturer or supplier warranty may be required to be returned to the supplier and therefore may not be available to the customer.

CUSTOMER-SUPPLIED PARTS

#

The Hop Shop may decline to install customer-supplied parts when doing so creates an unreasonable safety, fitment, quality, warranty, or liability concern.

When The Hop Shop agrees to install customer-supplied parts:

  • the customer is responsible for confirming that the parts are correct and suitable;
  • The Hop Shop does not warrant the part itself;
  • The Hop Shop is not responsible for defects, incorrect fitment, missing components, poor manufacturing, premature failure, or consequential labor caused by the supplied part; and
  • removal and replacement of a failed customer-supplied part may require additional labor charges.

Unless expressly stated otherwise in writing, customer-supplied parts do not receive The Hop Shop's standard parts-and-labor warranty.

STANDARD WARRANTY

#

Unless a service is specifically excluded or different warranty terms are stated in writing, qualifying repairs using parts supplied by The Hop Shop are covered by a limited warranty for:

12 months or 12,000 miles, whichever occurs first.

The warranty applies to covered parts and workmanship associated with the authorized repair.

Warranty coverage does not extend to failures caused by circumstances including:

  • normal wear;
  • abuse, misuse, racing, competition, or off-road use;
  • collision or external damage;
  • overheating;
  • fluid loss;
  • contamination;
  • corrosion or rust;
  • pre-existing damage;
  • modification;
  • failure of another component;
  • improper maintenance;
  • continued operation after warning signs appear;
  • customer-supplied parts;
  • unauthorized alteration or repair by another person; or
  • conditions outside the scope of the original repair.

Wear items may carry different or no labor warranty depending on the service and circumstances.

Any manufacturer or supplier warranty is subject to that manufacturer's or supplier's terms.

WARRANTY CLAIM PROCEDURE

#

The customer must notify The Hop Shop of a suspected warranty issue within the applicable warranty period.

The Hop Shop must be given a reasonable opportunity to inspect and diagnose the claimed failure before repairs are performed elsewhere.

A warranty claim may be denied when another shop or individual repairs, alters, dismantles, replaces, or otherwise interferes with the claimed component before The Hop Shop has had a reasonable opportunity to inspect it, except where emergency circumstances or applicable law require otherwise.

Warranty coverage will be determined after inspection.

A warranty claim does not automatically establish that the original repair was defective.

CUSTOMER DECLINES RECOMMENDED REPAIRS

#

Customers may decline any recommended service.

When the customer declines a repair involving a safety, reliability, drivability, fluid-loss, overheating, electrical, braking, steering, suspension, tire, or other concern, the customer accepts responsibility for continued operation of the vehicle.

The Hop Shop may document declined recommendations on the estimate, invoice, inspection report, or customer record.

The Hop Shop may refuse to operate or road-test a vehicle that it reasonably believes is unsafe.

TEST DRIVES AND VEHICLE OPERATION

#

The customer authorizes The Hop Shop and its employees, contractors, or agents to operate the vehicle when reasonably necessary for diagnosis, verification, repair, calibration, testing, quality control, transportation connected with the authorized service, or confirming the effectiveness of a repair.

Reasonable road testing may occur before, during, or after service.

PRE-EXISTING CONDITIONS AND INCIDENTAL DAMAGE

#

The Hop Shop is not responsible for the failure of aged, brittle, deteriorated, corroded, seized, previously damaged, improperly installed, modified, or previously repaired components when reasonable care is used during authorized service.

Certain repairs require removal or disturbance of adjacent components.

The Hop Shop will use reasonable care but cannot guarantee that aged or deteriorated surrounding parts will withstand normal disassembly.

If additional repairs become necessary, customer approval will be obtained before performing material additional work.

PAYMENT

#

Unless other arrangements are approved in writing, the remaining balance is due upon completion of the authorized work.

The customer remains responsible for payment of authorized labor, diagnostics, parts, taxes, fees, and other properly disclosed charges.

Completion of service is not conditioned upon the vehicle achieving a perfect or customer-subjective result when the authorized work was properly performed.

Failure or refusal to pay does not become justified solely because another vehicle problem exists or additional diagnosis or repair is recommended.

The Hop Shop may decline future service when an account remains unpaid.

REFUNDS

#

Automotive repair and diagnostic services involve technician labor, consumed materials, purchased parts, and professional services that generally cannot be returned once performed.

Accordingly, properly authorized and properly performed labor and diagnostic services are generally non-refundable.

A customer is not entitled to a refund merely because:

  • another vehicle problem remains;
  • an additional failure is later discovered;
  • a separate component fails;
  • the vehicle does not become perfect after one repair; or
  • additional diagnosis or repair becomes necessary.

Nothing in these Terms eliminates any remedy or right that cannot lawfully be waived.

When The Hop Shop determines that covered workmanship or a covered part is defective, the issue will be addressed under the applicable warranty or other remedy required by law.

CHARGEBACKS AND PAYMENT DISPUTES

#

A payment-card chargeback, bank dispute, stop-payment request, or other payment reversal does not automatically cancel the customer's obligation to pay for authorized services.

The Hop Shop may provide estimates, authorizations, invoices, photographs, technician notes, communications, inspection results, booking records, payment records, and other documentation to the payment processor or financial institution when responding to a payment dispute.

Nothing in this section prevents a customer from exercising rights lawfully available through their payment provider.

UNPAID BALANCES, COLLECTIONS, AND LIEN RIGHTS

#

The customer is responsible for authorized charges that remain unpaid.

The Hop Shop reserves all rights and remedies available under Idaho law concerning unpaid labor, diagnostics, parts, materials, storage where applicable, and other authorized charges.

Where legally permitted and all statutory requirements are satisfied, those remedies may include collection activity, recovery of allowable costs, assertion or enforcement of lien rights, and retention or other lawful remedies concerning a vehicle or property.

Nothing in these Terms expands The Hop Shop's lien rights beyond those provided by applicable law.

ABANDONED OR UNCLAIMED VEHICLES

#

When a vehicle or property remains in The Hop Shop's possession after completion, cancellation, or termination of work, The Hop Shop may provide notice requiring the owner to retrieve the property and pay outstanding authorized charges.

Any storage charge, lien enforcement, disposition, towing, or treatment of abandoned property will be subject to applicable law and any required notice.

PHOTOGRAPHS AND SERVICE RECORDS

#

The customer authorizes The Hop Shop to photograph or record the vehicle, parts, damage, diagnostic findings, work performed, odometer reading, VIN, and other service-related information for documentation, warranty, training, insurance, payment-dispute, quality-control, and recordkeeping purposes.

Customer-identifying information will not intentionally be published for advertising purposes without appropriate authorization.

The Hop Shop may retain service documentation as part of its ordinary business records.

ELECTRONIC COMMUNICATIONS

#

The customer consents to receiving service-related communications by telephone, text message, email, booking platform, or other contact method provided by the customer.

Electronic communications may be used for estimates, approvals, appointment information, invoices, service updates, warranty matters, and other communications relating to the customer's vehicle or account.

DETAILING SERVICES

#

Detailing results depend upon the age, condition, materials, previous treatment, staining, damage, contamination, oxidation, scratches, clear-coat condition, and other characteristics of the vehicle.

The Hop Shop does not guarantee complete removal of every stain, odor, scratch, defect, contaminant, or cosmetic imperfection.

Pre-existing deterioration or damage may become more visible after cleaning.

PERSONAL PROPERTY

#

Customers should remove valuables and unnecessary personal property before service.

The Hop Shop is not responsible for loss of unsecured personal property that was not specifically delivered to and accepted by The Hop Shop for safekeeping, except to the extent responsibility cannot lawfully be excluded.

THIRD-PARTY AND SUBCONTRACTED SERVICES

#

Certain services may require outside vendors, machine shops, towing companies, dealerships, programmers, alignment providers, glass companies, parts suppliers, or other third parties.

The Hop Shop may coordinate such services when authorized by the customer.

Third-party warranties, schedules, policies, and limitations may apply to their work.

FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL

#

The Hop Shop is not responsible for delays caused by circumstances reasonably outside its control, including severe weather, fire, natural disaster, supply-chain disruption, shipping delay, parts shortage, utility failure, road closure, illness, governmental action, or failure of a third-party provider.

CUSTOMER INFORMATION

#

The customer is responsible for providing accurate contact, vehicle, location, and ownership information.

The customer must promptly notify The Hop Shop of material information affecting the requested service, including significant modifications, prior repairs, known safety problems, immobilizer systems, aftermarket electronics, tuning, or other conditions relevant to diagnosis or repair.

DISPUTE RESOLUTION AND OPPORTUNITY TO CORRECT

#

Before filing a lawsuit concerning workmanship or service quality, the customer is encouraged to provide The Hop Shop written notice describing the claimed issue and a reasonable opportunity to inspect the vehicle and attempt to resolve the matter.

This provision does not require a customer to delay action when doing so would cause the expiration of a legal deadline or where applicable law provides otherwise.

The parties may voluntarily attempt informal resolution, mediation, or another mutually agreed dispute-resolution method.

Nothing in these Terms requires binding arbitration unless the customer and The Hop Shop separately agree to arbitration in a legally enforceable agreement.

GOVERNING LAW

#

These Terms and services performed by The Hop Shop are governed by applicable federal law and the laws of the State of Idaho.

Any venue or jurisdiction provision ultimately included in these Terms will be subject to applicable law.

SEVERABILITY

#

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

An invalid provision should be interpreted or limited, where legally permissible, to most closely accomplish its intended lawful purpose.

NO WAIVER

#

Failure by The Hop Shop to enforce a provision of these Terms in one situation does not permanently waive that provision or prevent its enforcement in another situation.

ENTIRE SERVICE AGREEMENT

#

These Terms, together with the customer's applicable estimate, work order, invoice, service authorization, warranty statement, and any written amendments or approved additional work, constitute the agreement concerning that particular service.

If a specific written term on an approved estimate or work order directly conflicts with these general Terms, the specific written term for that service will control to the extent of the conflict.

CHANGES TO TERMS

#

The Hop Shop may revise these Terms for future services.

The version applicable to a particular service will be the version presented or made available to the customer when that service is booked or authorized.

Changes will not retroactively alter a previously authorized service agreement unless both parties agree.

ACKNOWLEDGMENT AND AUTHORIZATION

#

By signing, electronically accepting, approving an estimate, paying the required deposit, booking service subject to these Terms, or otherwise authorizing work after receiving access to these Terms, the customer acknowledges that they:

  1. have had an opportunity to review these Terms;
  2. authorize the services specifically approved in the applicable estimate or work order;
  3. understand that automotive diagnosis and repair cannot guarantee correction of every vehicle condition;
  4. agree to pay properly authorized charges;
  5. understand the applicable deposit and warranty terms; and
  6. agree to these Terms to the extent permitted by law.
